Construction Litigation

The firm has extensive experience handling complex construction defect and construction contract cases. We represent owners, developers, general contractors, sub-contractors, manufacturers and design professionals involved in government, commercial and residential projects. Due to the complex nature of construction litigation, we often encourage alternative dispute resolution procedures, early evaluation and creative resolutions in order to efficiently manage these difficult cases. The firm's litigation prowess is greatly enhanced by the construction experience of attorney George Guthrie, who is also a licensed general contractor. Mr. Guthrie's in-depth and practical knowledge of the construction industry often provides the crucial advantage necessary in seeking a successful resolution for our clients.

Insurance Coverage for Construction Defect Claims

Because the fees and costs necessary to defend any claim or lawsuit can be expensive, our clients benefit from the firm's unique expertise in construction related matters involving insurance coverage. In many cases insurers have been persuaded to pay the clients' attorney's fees and costs during litigation, even after previously refusing such requests.  All potential sources of coverage are examined by the firm, including the clients' own policies and policies of other parties, such as sub-contractors.

Sometimes the construction contracts and sub-contracts shift responsibility for paying litigation expenses from one party to another, making it possible to demand that another party pay the client's litigation costs. Complete protection of each client's interests requires that all such issues be considered, in addition to providing the best representation in the litigation itself. The firm utilizes its legal knowledge as one of California's premier insurance coverage firms, in conjunction with its strong construction and litigation background, in seeking all possible insurance policy benefits for our clients.

Construction Contracts

The firm also advises and represents clients in disputes regarding construction claims, payments and liens, as well as negotiating and preparing contracts.  We have experience representing owners, developers, general contractors, sub-contractors, manufacturers and design professionals in their construction contract needs.
